Florida Gay Adoption Ban Unconstitutional

Today a Florida circuit court today struck down a state law that bars lesbians and gay men from adopting. The court granted adoptions to our client Martin Gill, a North Miami resident who, along with his partner, has been raising two foster children since 2004. The court ruled that the ban violated the equal protection guarantees of the state constitution because it singles out gay people and children raised by gay people for different treatment for no rational reason. The court also found that the ban denies children the right to permanency provided by federal and state law under the Adoption and Safe Families Act of 1997. The courts decision comes after a four-day trial in October where the court heard from experts on childrens health and development and the justifications offered by the state for the ban. In reaching its decision, the court rejected the false assumptions and stereotypes about gay people that the state offered to justify the ban, holding that many reports and studies find that there are no differences in the parenting of homosexuals or the adjustment of their children. These conclusions have been accepted, adopted and ratified by the American Psychological Association, the American Psychiatry Association, the American Pediatric Association, the American Academy of Pediatrics, the Child Welfare League of America and the National Association of Social Workers. As a result, based on the robust nature of the evidence available in the field, this Court is

allhomosshoulddie, if I could ask you a question, given the name you chose as your UserID on YouTube, do you really believe that all homosexuals should die? If you do, why?

  2. SeanChapin1 Says:

Thanks for your response. Why are gay people evil?

It is sad to see that many people still hate gays more than they love unwanted children. A loving, caring and nurturing home can be provided by any adults who possess those qualities of human kindness. Their sexual orientation has nothing to do with parenting skills.

25% of all children in this country are abused and/or neglected. The overwhelming majority of abused and neglected children see such abuse while in the care of their own, heterosexual parents.

Shame on those who teach hate.

Gay people raising kids? This country really is fucked.

  5. Claudia7778 Says:

Steven, those kids were abandoned by heterosexual parents. They are happy and taken care of now. You obviously care more about being a bigot than about the actual welfare of children.

If I were an orphan and I should choose between a well-situated gay couple and an orphanage, the decision would be made in a split second! Living with gay parents might be somehow odd, but still it would be a thousand times better off than the orphanage 4 shou.

Fags should never be trusted around children.

  12. BeanzyBoo Says:

every body needs to leave all gays alone! i mean did they ever mess with anybody? no i’m not gay but i know alot of gay people who r awesome! it might be a little weird at first but they r just like any body else except they hav a different taste in who they like, so leave them alone!

I just don’t understand how Florida will let me (a lesbian) be a foster parent and take in children at 3 in the morning and pick up where everything has fallen apart and provide a loving home and stability but I cannot adopt these children that I have opened my heart to. It’s sad and so hurtful.

  16. Elcristoph Says:

the reason is the debate on the subject isnt based on social studies or a rational perspective its based on philosophy. which basicaly means even if your right your still seen as wrong.

This is the reason for Gay Marriage, to be able to ADOPT children.

The media does not say that, therefore, people ignore it and make it a “love” issue, “because they love each other”.

A child needs a mother and a father to give an example of how things should be in life, to make a family and reproduce.
You became gay because of physiological impulses, let a kid have a mom and dad, the perfect balance of a family.

You’re such an imbecile. Your close minded views are becoming more and more scarce. have a great day! 🙂

It hurts, I know, but nature is beautiful.

  20. alecia567 Says:

It doesn’t hurt at all! You’re the one who will be in pain when your small mind is forced to expand. Nature is beautiful! K bye!

  21. mattyabsley Says:

“You became gay because of physiological impulses, let a kid have a mom and dad, the perfect balance of a family. ” – Yeah, perfect balance, is that the same balance that get’s divorced like fucking stupid, is that the same balance where dad nips out late at night to get fucked up the ass by gay men in toilets? is that the same perfect balance that ends up with dad cheating with the neighbour cos it’s soooo not the perfect balance. Shutup, really. You know nothing,.

  22. rainbowheartgirl Says:

What are you talking about? Gay adoption has been legal for decades! The only state that used to outlaw it was Florida, and you can see that’s no longer the case. This has nothing to do with gay marriage. I have two gay dads who just got married last year, but they’ve been together over 25 years and have 3 kids! Our second dad adopted us way back when we were little. Gay adoption has been legal for a long, long time.
